Victoria is the exception in Australia: once you have 7 years of continuous service, your long service leave is payable when employment ends for any reason — resignation, dismissal, even serious misconduct. Enter your details below to see what you have accrued.

Victoria — the rules

Under the Long Service Leave Act 2018 (Vic), entitlement accrues at 1/60 of your continuous service. That works out to about 6.07 weeks at 7 years and 8.67 weeks at 10 years.

You can take the leave from 7 years of service. From that point it is also payable when your employment ends for any reason, including resignation, dismissal and serious misconduct.

Continuous service includes casual service and most types of leave, so a break in work is not automatically a break in service.

ServiceWhat you get
Under 7 yearsNothing payable yet — still accruing
7 years or moreFull accrued entitlement — take it, or be paid it out on ending, for any reason

Worked example: 11 years on $1,100 a week

11 years × 52 ÷ 60 = 9.5333 weeks. At $1,100 a week that is 9.5333 × $1,100 = $10,486.67.

Methodology note: Victoria's official guidance rounds the weeks to 2 decimal places before valuing, which gives $10,483 for this example. This calculator uses exact accrual, so the difference is a few dollars, and your employer's payroll method governs the final figure.

Taking the leave vs being paid out

From 7 years you can ask to take your leave, by agreement with your employer, in periods that suit you both — including as little as a single day. If you would rather not take it, nothing is lost: it stays accrued.

If your job ends after 7 years, the unused balance is paid out as a lump sum, whatever the reason for leaving.

Yes. Once you have 7 years of continuous service you can take your accrued leave, by agreement with your employer, including in shorter periods.

I was dismissed for misconduct in Victoria — do I still get long service leave?

Yes, if you have at least 7 years of continuous service. Victoria is the exception in Australia: accrued long service leave is payable when employment ends for any reason, including serious misconduct.

Do casuals accrue long service leave in Victoria?

How is Victorian long service leave taxed when paid out?

A payout is a lump sum included in your assessable income and generally taxed at your marginal rate, with tax withheld by your employer. A small portion of very old service may be treated differently — check with the ATO or a tax adviser.
